Welcome to DatingAbove. By accessing or using our platform at datingabove.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to use DatingAbove. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You may not create more than one account, use another member's account, or transfer your account to any other person.

3. Membership and Payments

DatingAbove offers both free and paid membership tiers. Paid memberships are billed on a recurring subscription basis at the rate and frequency selected at the time of purchase.

• Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period, and you will retain access until that date
• Refunds are handled on a case-by-case basis and are not guaranteed for partially used billing periods
• We reserve the right to change subscription pricing with 30 days advance notice

4. Community Standards

DatingAbove is a platform for creating genuine, respectful connections. By using the Service, you agree not to:

• Use the platform for any form of solicitation, prostitution, or commercial sexual services
• Post content that is obscene, pornographic, violent, or promotes illegal activity
• Harass, threaten, stalk, or intimidate any other member
• Create fake or misleading profiles or impersonate another person
• Use the platform for commercial purposes, advertising, or spam
• Attempt to collect personal information from other members for unauthorized purposes
• Use automated systems, bots, or scrapers to access the platform
• Violate any applicable local, state, national, or international law

Sugar dating, financial arrangements, and all forms of transactional relationships are strictly prohibited on DatingAbove. Accounts found to be facilitating such arrangements will be permanently banned without refund.

5. Content You Submit

You retain ownership of content you submit to DatingAbove, including photos, profile text, and Date Diary entries. By submitting content, you grant DatingAbove a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for the content you submit and represent that it does not infringe on any third-party rights. We reserve the right to remove any content that violates these Terms or our community guidelines.

6. Safety and Reporting

DatingAbove provides tools for reporting and blocking other members. If you encounter behavior that violates these Terms or makes you feel unsafe, we encourage you to use these tools and to contact our support team. We investigate all reports and take appropriate action, which may include warnings, suspensions, or permanent bans.

While we take reasonable steps to verify member identities and moderate content, we do not conduct criminal background checks on all members and cannot guarantee the identity or behavior of any member. You are responsible for taking reasonable precautions when interacting with other members, both online and in person.

7. AI-Powered Features

DatingAbove uses artificial intelligence to power certain features, including match recommendations, compatibility scoring, and conversation suggestions. While we strive for accuracy, AI-generated content and suggestions are provided for informational purposes only and do not constitute guarantees of compatibility or relationship outcomes.

8. Intellectual Property

The DatingAbove name, logo, website design, features, and all related intellectual property are owned by DatingAbove and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent.

9. Limitation of Liability

DatingAbove is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, DatingAbove shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to damages related to interactions with other members.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to DatingAbove in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other members, or is otherwise inappropriate. You may delete your account at any time through your account settings.

11. Dispute Resolution

Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state of Delaware, and the arbitrator's decision shall be final and binding.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
